How we look after your data.

Clario is a UK creative agency. We use personal information to respond to enquiries, provide and improve our creative services, manage client and supplier relationships, run our website, promote our business where permitted, and meet legal obligations.

 

We also process personal information on behalf of clients when delivering services such as websites, campaigns, PR, content, events or direct mail. We do not sell personal information.

01 Who we are

Clario Creative (”Clario”, “we”, “us”, or “our”) is a full-service creative agency based in the United Kingdom.

 

Our services includes brand and graphic design, website design and development, content and copywriting, marketing communications, campaigns, public relations support and related creative services.

 

For personal information we use for our own business, Clario is generally the controller. This means we decide why and how the information is used.

 

When a client gives us personal information and instructs us how to use it as part of a project, we will usually act as the client’s processor. Our role depends on the circumstances of each activity.

02 Scope of this Statement

This statement explains how we handle personal information when you:

 

  • Visit our website;
  • Contact us or ask for a proposal;
  • Become a client, supplier, freelancer or business partner;
  • Attend an event;
  • Receive marketing from us;
  • Apply to work with us; or
  • Otherwise interact with Clario.
 

It also explains how we may handle information about people connected with our clients’ projects.

 

Where a client controls the information and Clario acts only on that client’s instructions, the client’s own privacy notice will normally be the main notice for the people concerned.

 

Questions or rights requests to that information should usually be directed to the relevant client, although we will assist the client where required.

03 Personal Information we Collect

We may collect:

 

  • Identity and contact details, such as your name, organisation, role, postal address, email address and telephone number;
  • Enquiry, briefing and project information, including correspondence, meeting notes, preferences, feedback, approvals and files you provide;
  • Commercial and account information, such as proposals, contracts, purchase orders, invoices, payment status and transaction records;
  • Marketing preferences and records of your interactions with our communications;
  • Recruitment information, such as CV, portfolio, employment history and information provided during an application; and
  • Any other information you choose to provide.
 

We do not normally store full payment-card details.

Special Category and Criminal Offence Information

We do not routinely seek sensitive personal information.

 

A project may occasionally require this type of information, for example where content concerns health, accessibility, equality, beliefs or trade-union matters, or where photographs or video reveal sensitive characteristics.

 

We will only handle this information where there is a legal valid condition, appropriate safeguards and a clear project need.

 

Please do not send sensitive information unless we have agreed that it is necessary and suitable security arrangements are in place.

04 How and why we use Personal Information

Enquiries, Proposals and new Business

We use information to respond to enquiries, understand requirements, prepare proposals, arrange meetings and manage prospective client relationships.

Our lawful bases are usually taking steps before entering into a contract and our legitimate interests in developing and operating our business.

Client Services and Project Delivery

We use information to plan and deliver design, digital, content, marketing, PR and related services. This includes communicating with clients, obtaining approvals, managing changes and maintaining quality.

Our lawful bases may include contract, legitimate interests and legal obligations.

Client-Supplied Information

We may use information provided by a client to create or manage websites, campaigns, publications, mailing activities, events, research, content or other agreed services.

In these circumstances, we will usually act as a processor under the client’s instructions and contract.

Accounts and Administration

We use information to manage contracts, billing, payments, suppliers, insurance, audits and business records.

Our lawful bases may include contract, legal obligations, and our legitimate interests in sound business administration.

Marketing and Relationship Management

We may use information to send relevant news, examples of our work, invitations or other information about our services. We may also record preferences and measure engagement.

We use information to assess applications, communicate with applicants, verify information and manage freelance contractors.

We may use information to protect our rights, investigate issues, respond to lawful requests and establish, exercise or defend legal claims.

05 Where we act for Clients

Creative projects can involve personal information belonging to clients:

Where Clario processes that information solely on the client’s documented instructions, the client is responsible for:

  • Ensuring that it was obtained lawfully;

  • Handling individual rights requests.
 
Clario will:
 
  • Use the information only to deliver the agreed service;
  • Apply appropriate security measures;

Where you contact us about information controlled by one of our clients, we may need to refer your request to that client.

06 Sharing Personal Information

We share personal information only where reasonably necessary and with appropriate protections.

We require suppliers handling personal information for us to protect it and use it only for authorised purposes. We do not sell or rent personal information to third parties.

07 International Transfers

Some service providers may store or access personal information outside of the United Kingdom.

 

Where this happens, we use an appropriate lawful transfer mechanism and safeguards. These may include:

We may contact business contacts with relevant information about Clario, our work, events or services where permitted by law.

 

Electronic marketing is sent on the basis of consent where required, or otherwise in reliance on legitimate interests and applicable business-to-business marketing rules.

10 Retention

We keep information only for as long as reasonably necessary for the purpose for which it was collected.

 

We also consider legal, contractual, tax, accounting, insurance and dispute requirements.

 

Our indicative retention periods are:

 

  • Enquiries that do not become clients: normally up to 24 months after the last meaningful contact.
  • Client, supplier and financial records: normally for the duration of the relationship and then for up to seven years, subject to legal and insurance requirements.
  • Project working files and final deliverables: according to the contract, operational need and agreed archive arrangements.
  • Client-supplied campaign, mailing or event data: deleted or returned following delivery in accordance with the contract, normally within six months, unless otherwise instructed or legally required.
  • Recruitment information for unsuccessful applicants: normally up to six months, unless the applicant agrees to a longer talent-pool period.
  • Marketing records: until you opt out or the information is no longer relevant, with suppression records retained where necessary to honour preferences.
  • Cookie and analytics information: for the periods stated within our Cookie Policy and consent tool. 
 
We may retain information for longer where necessary for a legal claim, regulatory enquiry, security investigation or another lawful reason.

 

At the end of the applicable retention period, information will be securely deleted or anonymised.

11 Security

We use proportionate technical and organisational measures designed to protect personal information.

 

These may include:

 

  • Access controls;
  • Authentication;
  • Encryption where appropriate;
  • Secure configuration;
  • Backups;
  • Supplier due diligence;
  • Confidentiality obligations;

No internet transmission or storage system is completely secure, so we cannot guarantee absolute security.
 
Please use an agreed secure transfer method rather than ordinary email for particularly sensitive or high-volume information.

13 Automated Decision-Making

Clario does not currently make decisions about people using a solely automated processing that produces legal or similarly significant effects.

 

Should this change, we will update this notice and provide the information required by law.

14 Children and Imagery

Our services are primarily business-to-business and our website is not directed at children.

 

We do not knowingly collect children’s personal information through the website.

 

Creative work may, however, include photographs, video, quotes or other information relating to children.

 

In those circumstances, we require the relevant client or content provider to confirm that:

 

  • An appropriate lawful basis, permission or consent is in place;
  • The appropriate use is suitable; and
  • Appropriate safeguards have been applied.
